1. Intellectual or industrial property
Armilar Business Services, SL (Armilar), with Tax Identification Number B88177613, is the owner of all licenses and rights (intellectual or industrial property) over the IT solutions and/or services marketed, advertised, and/or made available on this website.
Thus, the use of the solutions and services by a client/user not only does not grant any intellectual or industrial property rights but also does not grant permission to use any ARMILAR brand or logo.
ARMILAR’s solutions and services must be used with respect to the law and the rights of third parties, and it is considered a violation of the terms of use (terms) the misuse of the solutions and services by any customer or user.
2. Acceptance of the conditions
These conditions of use apply to all customers/users of ARMILAR solutions/products, and their knowledge and acceptance by them are mandatory.
ARMILAR reserves the right to modify and improve the solutions and services it provides to its customers/users and may add or remove features and/or characteristics, as well as suspend or terminate them, in which case customers/users will be informed at least 30 (thirty) days in advance.
These terms apply exclusively between ARMILAR and the customer/user and do not create any rights for third parties, including access, use, or compensation.
For the resolution of any conflict arising from the use of ARMILAR’s solutions and services, Spanish legislation and the jurisdiction of Madrid shall apply.
3. Use of Armilar services and solutions
The use of ARMILAR’s solutions and services shall be in accordance with the instructions and compatibility requirements shared by ARMILAR, which shall not be liable for any error, loss, compensation, or damage caused by failure to comply with this clause.
The client/user shall, at the time of formalizing the subscription to the service and/or solution, complete and provide all the data necessary for the provision of the services or the implementation/parameterization of the solution.
ARMILAR’s services and solutions have the price and contractual duration indicated in the contractual documentation or in the online shop, and such information is sent by e-mail to the customer or user for the purpose of contractual proof.
Access to ARMILAR’s services and solutions (and to the information and content obtained through them) is exclusive to the entity that acquires them, and it is expressly forbidden to share access with other entity(ies), whether or not they are ARMILAR’s client(s).
In case of breach of contract, ARMILAR reserves the right to unilaterally terminate the contract with immediate effect and with the corresponding limitation of access to the services, without prejudice to the right to full compliance with the agreed financial obligations.
4. Content and information
ARMILAR reserves the right to remove, edit or delete any content or information that it determines or understands to be illegal and/or in breach of our policy, terms of use, or the law, although this cannot be construed as a commitment by ARMILAR to value the content and information.
Armilar provides market intelligence services to improve the competitiveness of its clients. Various sources are used, public or through agreements with data sources, over which Armilar has no control and for which it assumes no responsibility, and always uses aggregated data, i.e. at no time are direct relationships established between a buyer, a supplier, a product and a price.
Considering the multiplicity of sources, possible incorrect product descriptions, or possible errors in the input or processing of data, Armilar does not assume any liability in connection with the information provided. The information provided is not necessarily exhaustive and complete and should be understood as a mere suggestion and not as any kind of recommendation, being neither binding nor definitive.
Armilar, its partners, administrators, legal representatives, and employees do not guarantee its accuracy, updating, precision, adequacy, completeness, or veracity, nor are they responsible for the accidental publication of incorrect data.
The success or failure of an act carried out on the basis of the information/data/reports/suggestions submitted or the competitiveness of the proposals submitted by a CLIENT cannot be attributed to ARMILAR, being the CLIENT responsible for the interpretation and consequent commercial strategy to be followed on the basis of the information/data/reports/suggestions obtained through ARMILAR.
Therefore, ARMILAR provides its solutions and services with the highest level of competence and we expect our customers and users to obtain maximum satisfaction when accessing and using them.
5. Activity and obligations
The customer and/or user is responsible for his activity and use of ARMILAR’s solutions and services, being responsible for ensuring the protection of his account and access data, as well as for the existence and maintenance of all hardware and software necessary for it, as well as for the access and use of ARMILAR’s solutions and services.
Use of ARMILAR’s solutions and services may involve accessing, making available, uploading, displaying, storing, sending, or receiving content and information.
The customer and user retain ownership of all intellectual property rights it owns to such content and information.
The customer and/or user by accessing, making available, uploading, submitting, storing, sending, or receiving content and information is authorizing the processing of such data by ARMILAR, authorizing its use and availability in such services and solutions, even in those situations in which the customer or user stops using our services and solutions for historical purposes, provision of services to third parties and/or as legal or other similar evidence.
These are the Customer’s/user’s obligations regarding ARMILAR’s solutions and/or services:
1. Take all measures to avoid compromising the security of the network;
2. Make correct use of the services and/or solutions;
3. Not to copy, disseminate, transmit or transfer in any form the content and information provided by ARMILAR;
4. Acknowledge that the information and content entered, uploaded, submitted or submitted on ARMILAR solutions or services are your sole responsibility;
5. Guarantee that access to ARMILAR’s services and solutions is used exclusively by the entity that acquired them.
Failure to comply with the obligations set forth in the preceding paragraph, and in particular in paragraph 3, shall entail for the Client/user the obligation to indemnify ARMILAR for all damages, both consequential and loss of profit, caused and under the terms of the general regulations.
The customer and/or user acknowledges that when providing a service by ARMILAR using remote access to their computer or desktop on an ARMILAR solution, they must validate all activity performed by the ARMILAR operator or employee on behalf of their entity.
The customer further expressly acknowledges that ARMILAR shall not be liable for any action taken on such remote access that causes or may cause damage or loss to the customer of any opportunity, contract, information, or content, including lost profits.
6. Marketing and data usage
ARMILAR treats all transactional, commercial, and personal data of its customers and users with the strictest confidentiality.
ARMILAR guarantees a policy of confidentiality in communications and the adoption of security measures against destruction, loss, modification, and improper access to information and content, complying with all legislation applicable to its activity, in the different countries where it operates or will operate.
The customer and user may, at any time, stop using an ARMILAR service or solution, and such decision shall not be understood as just cause for termination of the contract or contracts in force.
ARMILAR guarantees to the holders of personal data subject to the scope of application of Regulation (EU) 2016/679 all the rights provided for in Chapter III of that Regulation, as well as in the applicable national legislation. ARMILAR guarantees data subjects subject to the scope of application of Statutory Law 1581 of 2012 (October 17) – Habeas Data Law – the rights set forth in art. 8. To exercise any right related to personal data you should use the tools provided in the solutions or send an email to marketing@armilar.biz indicating what you want. The customer and user authorize the processing of their data, including personal data, for the provision of services and the use of ARMILAR services, without which such services cannot be provided without limitations.
ARMILAR may send you service or solution advertisements, administrative messages (such as contractual or billing messages) related to the use of our solutions and services while guaranteeing at all times the option not to receive some or all of these communications.
