1. Intellectual or Industrial Property
Armilar Business Services, S.L. (ARMILAR), with VAT Number B88177613, is the holder of all the necessary licenses and of all the rights (of intellectual or industrial property) since it is the owner, co-owner and holder of the license on the informatic solutions and/or services commercialized, advertised and/or available in the present website.
In this way, the use of the solutions and services by a client or user does not give him any intellectual or industrial property rights, nor does it authorise him to use any ARMILAR brand or logo or to be a user in more solutions and services.
Unless expressly authorised by ARMILAR or the conditions set out in the Law, the use of the content of ARMILAR's solutions and services is expressly prohibited.
2. Acceptance of Terms
ARMILAR reserves the right to constantly change and improve its solutions and services, and may add or remove functions or features, as well as suspend or cease them, in which case clients and users will be informed with reasonable notice.
These terms apply exclusively between ARMILAR and the client or user, not creating any rights to third parties, in particular access, use or compensation.
To resolve any dispute arising from the use of ARMILAR's solutions and services, the laws of Spain and the jurisdiction of Madrid shall apply.
These terms shall not apply where any particular or contractual condition conflicts with these terms, in which case these terms shall prevail.
3. Use of Armilar Services and Solutions
Solutions and services shall be accessed in accordance with ARMILAR's shared instructions and compatibility requirements, and ARMILAR shall not be liable for any error, damage, indemnity or harm caused by failure to comply with this clause.
At the time of formalising the acquisition of the service or in the subscription of the solution, the client and/or the user must fill in all the necessary data for the delivery of the services.
ARMILAR's services and solutions have the price and the contractual duration indicated in the contractual documentation or in the online shop, being this information sent via e-mail to the client or user for contractual proof purposes.
Access to ARMILAR's services and solutions (and the information and content obtained through them) is unique to the entity that has acquired them, and shared access by other entity(ies), whether ARMILAR client(s) or not, is expressly prohibited.
In case of breach of contract, ARMILAR reserves the right to unilaterally terminate the contract, with immediate effect and with the corresponding limitation of access to the services, without prejudice to the right to full compliance with the agreed pecuniary obligations.
4. Contents and Information
ARMILAR offers market intelligence services to improve the competitiveness of its clients’ companies. There are several sources used, either publicly or through agreements with data sources, over which ARMILAR has no control and for which it assumes no responsibility. Aggregated data is always used, i.e. at no time is a direct relationship established between a buyer, supplier, product and price.
Considering the multiplicity of sources, product descriptions that may be incorrect or any error in data entry or processing, ARMILAR does not assume any responsibility for the information provided. The information transmitted is not necessarily exhaustive and complete and should be understood as a mere suggestion and not as a recommendation, nor as being non-binding or definitive.
ARMILAR, its partners, administrators, legal representatives and employees do not guarantee its accuracy, updating, precision, suitability, integrity or truthfulness nor are they responsible for the accidental publication of incorrect data.
The success or failure of an event based on the information / data / reports / suggestions presented, as well as the competitiveness of the proposals presented by a client cannot be attributed to ARMILAR. The client is responsible for the interpretation and the consequent commercial strategy to be followed based on the information / data / reports / suggestions obtained through ARMILAR.
Therefore, ARMILAR offers its solutions and services with the highest level of competence and we hope that our clients and users will obtain maximum satisfaction when accessing and using them.
5. Activity and Obligations
The client and/or user is responsible for his/her activity and the use of ARMILAR solutions and services, having the responsibility to ensure the protection of his/her account and access data, the existence and maintenance of the necessary hardware and software, as well as the access and use of ARMILAR solutions and services.
The use of ARMILAR's solutions and services may involve accessing, making available, loading, sending, storing, sending or receiving content and information.
The client and the user maintain the ownership of all intellectual property rights over such content and information.
By accessing, making available, loading, sending, storing, sending or receiving content and information, the user is authorising the processing of such data by ARMILAR. It will be allowing its use and availability in such services and solutions, even in situations where the client or user ceases to use our services and solutions for the purpose of storage, availability of services to third parties and / or as legal evidence or other similar.
The client and/or user when using ARMILAR solutions and services must:
1. Take all measures not to jeopardize the security of the network; 2. To make a proper use of the services and / or solutions; 3. To avoid the disclosure of the content and information provided by ARMILAR; 4. Acknowledge that the information and contents introduced, uploaded, submitted or sent in ARMILAR's solutions or services is your sole responsibility; 5. Guarantee that access to ARMILAR services and solutions is used exclusively by the entity that has acquired them.
The client and/or user acknowledges that, at the time of providing a service by ARMILAR with remote access to his/her equipment or work area on an ARMILAR solution, he/she shall validate all the activity carried out by ARMILAR's operator or collaborator on behalf of his/her entity, expressly acknowledging that ARMILAR shall not be liable for any action carried out on such remote access that causes or may cause him/her damage or the loss of any opportunity, contract, information or content, including outgoing profits.
ARMILAR’s operators / consultants simply provide technical support. The final decision always depends on the client and/or user, and ARMILAR is not responsible for the information entered or uploaded incorrectly by the client and/or user.
6. Marketing and Use of Personal Data
ARMILAR is deeply committed to information security, offering maximum guarantees of quality, security and integrity in all its services.
ARMILAR processes all personal data in accordance with the Personal Data Protection laws and in accordance with Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR). All customers are guaranteed with the right to access, rectify, cancel and oppose the use of their personal data, as well as the possibility of requesting clarification through the email address email@example.com or of submitting a complaint to a control authority in the country where ARMILAR operates.
ARMILAR treats all transactional, commercial and personal data of its clients and users to which it has access with the utmost confidentiality. ARMILAR, in order to guarantee the security of personal data, implements all the necessary physical and logical security measures, using auditing and control mechanisms to ensure compliance with its security and personal data protection policies.
ARMILAR guarantees a policy of confidentiality in communications and the adoption of security measures against the destruction, loss, modification and improper access to information and content, complying with all legislation applicable to its activity, in the different geographies in which it operates or will operate in the future.
ARMILAR acts as the data controller or processor of the personal data collected during the period in which the contractual relationship lasts or what, according to the relevant legislation, is mandatory to maintain.
ARMILAR shall guarantee the holders of personal data subject to the scope of Regulation (EU) 2016/679 all the rights provided for in Chapter III of that Regulation, as well as in the applicable national legislation. The client and the user authorise the processing of their data, including personal data, for the provision of services and for the use of ARMILAR's services, without which such services cannot be provided without limitations.
ARMILAR is responsible for the processing of its clients' personal data and may subcontract a processing assignment that offers sufficient guarantees to implement appropriate technical and organisational measures, to be carried out on behalf of ARMILAR.
The cases in which ARMILAR is a co-owner or licensee of the IT solutions and/or services marketed, ARMILAR processes the personal data on behalf of the data controller, who may be a co-owner or owner of the IT solutions and/or services marketed.
In both the above situations, the controller and the processor have signed a contract in advance or some other legal act under the right of the Union or Member States' law, which binds the processor to the controller and states the purpose, duration, nature and purpose of the processing, the type of personal data and categories of data subjects, and the obligations and rights of the controller.
ARMILAR may send you service or solution announcements, administrative messages (such as contractual or billing messages) related to the use of our solutions and services, ensuring at all times the option not to receive some or all of these communications.

The client undertakes to keep the data updated and ARMILAR undertakes to fully comply with its obligations under the terms of the law in force regarding the protection of personal data and the rights derived from it for its holders.
